Ex-prison guards who were Ku Klux Klan members found guilty of conspiring to kill former black inmate

Two former Florida prison guards who
were also
Ku Klux Klan members have been found guilty of
plotting to kill a
black inmate after his release.
The murder plot involving Elliot
Moran and Charles
Newcomb started after a third guard, another Klan member,
was
bitten during a fight with the inmate. Moran, Newcomb
and Thomas Driver, the
third guard, believed the inmate was
infected with HIV and hepatitis.
Newcomb, Moran and Driver would
enlist an FBI informant
to kill the former inmate, and all three men were
arrested in 2015.
Driver pleaded guilty in March and
was sentenced to four years in prison.
A Columbia County jury found Moran and
Newcomb guilty of conspiracy
to commit first-degree murder, Attorney General
Pam Bondi's office said Tuesday.
"We will continue to work daily
to ensure the KKK or any other
hate-filled organization is unable to inflict
violence on the citizens
of our great state," Bondi said in a news
release.
During the multi-agency
investigation, the former guards were caught
on tape discussing the murder plot
with the informant. At one point the
guards discussed shooting the former
inmate if poisoning him with
insulin did not work, according to the Washington Post.
"If we have to do pow-pow, we
will," Newcomb told Moran and the
informant at one point, according to an
affidavit obtained by the
Washington Post.
Newcomb called himself the
"Exalted Cyclops" of the
Ku Klux Klan chapter, the newspaper
reported.
During the elaborate sting, the
guards were tricked into
thinking that the former inmate had been murdered.
"Photographs were shown to each
of the men. They expressed
happiness," state prosecutor Nick Cox told WJXT. "They shook
the source's hand and the source
even went to the point of asking
is this what you wanted."
At the time, Driver and Moran were
guards at the Department of
Corrections Reception and Medical Center in rural
north Florida.
Newcomb was a former correctional officer who had been fired in
2013.

Police charged 28 year-old Isaac Lee William Green sexual assault and burglary.
Police say it happened July 29th in the 1600 block of NW 3rd Place.
A report said the woman woke up to a tall, black man standing over her
bed, holding a cellphone.
Police say Green was arrested in connection with another incident on
August 3, after another incident involving prowling and exposing
himself. The report says officers obtained a search warrant for his
phone and found the video he shot with his phone at the woman's
apartment on July 29th. The report says the video shows his fingers
appear to be moving toward the victim's vagina.
The report says Green admitted to shooting the video and attempting
to touch the woman.
Green's being held at the Alachua County Jail on $400,000 bond

Trump condemns 'evil racism' in Charlottesville
US President Donald Trump has spoken out against racist violence after the killing of a protester in Charlottesville, Virginia, on Saturday.
"Racism is evil and those who cause violence in its name are criminals and thugs," he told reporters.
He said the Ku Klux Klan, neo-Nazis and white supremacists were "repugnant" to everything Americans held dear.
Mr Trump was criticised for not specifically denouncing extremists in his initial comments on the violence.
Heather Heyer, 32, died and 19 others were hurt when a car rammed into people protesting against a far-right march.

Police reveal how convicted killer planned escape from UK prison

A killer is believed to have fled overseas, six months after he was sprung from custody in an escape orchestrated from behind bars.
Shaun Walmsley, 28, was serving a 30-year term for murder when he was freed by two armed men as he left Aintree University hospital, Liverpool, under prison guard on 21 February.
Six months on, detectives pursuing him have revealed how Walmsley planned his escape for three months with the help of fellow prisoners and using mobile phones smuggled into HMP Liverpool.
Walmsley, a drug dealer who ran a nationwide crime network, was one of four men serving life sentences for the “savage” murder of Anthony Duffy, 33, who was lured to a street near Aintree racecourse and repeatedly stabbed in May 2014.
Police believe Walmsley planned his escape after an appeal against the severity of his sentence was rejected late last year.
Faced with the prospect of being in jail until his late 50s, Walmsley fooled prison medics into believing he had a serious illness – losing up to four stone in weight – so he could be referred to specialists at Aintree University hospital.

In a security lapse at one of his first hospital appointments, Walmsley learned the date of his follow-up visit, allowing him to set up the ambush for 21 February.
Walmsley was getting into a minicab with three prison guards when two masked men armed with a machine gun and a machete jumped from a gold-coloured Volvo. The two men threatened the guards, who released Walmsley from his handcuffs, allowing him to flee in the Volvo.
The two accomplices waited outside the hospital for 90 minutes before the ambush – proof they knew the exact time Walmsley was due at the hospital. The leak of the appointment details is believed to be at the centre of a Ministry of Justice and HMP Liverpool investigation into the incident.
Revealing Walmsley’s movements for the first time, Det Supt Natalie Perischine said Walmsley switched to a second vehicle, which was tracked to an address 35 miles away in Cheetham Hill, north Manchester, where it is believed he obtained new identity documents or a mobile phone. He has remained at large ever since.
Perischine said Walmsley was a “particularly dangerous individual” and that he planned his escape using mobile phones smuggled into HMP Liverpool. It is believed he was helped by fellow inmates at the category B prison, which has a “huge problem” with mobile phones: at least one drone a day attempts to smuggle in drugs, according to an independent monitoring board report last year.
Last week Merseyside police raided 11 properties and nine prison cells at HMP Liverpool that they said were linked to Walmsley, recovering six mobile phones from prisoners. Last Thursday police seized £7,000 in cash, a quantity of class A, B and C drugs, two stolen scrambler bikes and a thermal heat camera used by drug dealers to identify and steal rivals’ cannabis farms.
Perischine said: “Shaun Walmsley is a convicted killer who was sentenced to life for murder with a tariff of 30 years, he is a cold-blooded murderer and a particularly dangerous individual and we are determined to find him and we will not stop there.
“If you have assisted him in his escape from custody, or are providing him with the means to evade capture, we will come for you too. So think again about what you are doing and where your actions could lead to in the long term. Do the decent thing and let us know where he is.”
Thirty people, including a man from Liverpool who was on the run in Spain, have been arrested in the investigation into Walmsley’s escape, codenamed Operation Devon. Detectives have seized more than £165,000 in cash, large amounts of drugs and ammunition from 43 addresses, including in Merseyside, Bournemouth, Sussex and north Wales.
Sightings of Walmsley have been reported across the country, but detectives believe he is probably overseas, having previously planned to flee to Amsterdam after the murder of Duffy in 2014.
Perischine said there would be further arrests and that Walmsley being at large was “not good for the criminal fraternity”. “Some of the more sophisticated criminals are bringing themselves to police attention when maybe they wouldn’t have done,” she told the Guardian.
Detectives believe they have recovered a significant proportion of the money that would otherwise have been used to fund his life on the run. His associates would soon find their money running dry, Perischine said. “Crime is a business, whichever way you look at it. Him being on the run is bad for their business.”
She added: “We believe that Walmsley is probably abroad and therefore will need money to exist. Someone is funding him and in time it could prove to be exceptionally costly.
“My question to the person or persons who are helping Walmsley by providing him with cash for accommodation and general living expenses is this: Do you realise how much this will cost you in the long run and for what? Are you prepared to risk everything, including your lifestyle, family and friends, because that is what you are doing.”

Texas to move about 1,000 inmates because of prison heat

About 1,000 inmates sensitive to heat will be temporarily moved from a sweltering Southeast Texas prison without air conditioning to other state prisons to comply with a judge's order, the Texas Department of Criminal Justice said Thursday.
In a 12-page filing to U.S. District Judge Keith Ellison, the Texas Department of Criminal Justice said inmates whose health is worsened by heat over 88 degrees (31.11 Celsius) will be moved from the Pack Unit prison to state prisons that have climate-controlled, air-conditioned housing.
The department also said it would post signs around Pack Unit to inform inmates and officers where in the prison they can find respite if they become ill from the heat.
Ellison said last month that the prison system was "deliberately indifferent" to the heat risks. His preliminary injunction did not require the prison agency to install air conditioning in areas where heat-sensitive inmates are housed at the Pack Unit, about 65 miles (104.6 kilometers) northwest of Houston, but said those inmates needed to reside where temperatures are no higher than 88 degrees (31.11 Celsius) by reconfiguring areas already cooled.
The judge also said the heat-threatened inmates could be moved to other prisons around the state, the step the prison agency is taking. "Other options were considered but determined not to be practical or their effectiveness could not be guaranteed," prison system spokesman Jason Clark said in a statement.
"Adding temporary air conditioning in a prison not built for AC would be costly, and it's unknown whether untested equipment would bring the heat index to a level required by the court," he said.
The inmate transfers would be temporary because the facilities receiving them lack the infrastructure required long term, Clark said.
The judge's order, resulting from a lawsuit by six inmates who argued the intense heat at the Pack Unit threatened their health and violated their constitutional rights against cruel and unusual punishment, covered hundreds of the unit's nearly 1,500 inmates who already have a variety of health conditions or are at least 65 years old. More than 700 inmates, for example, have high blood pressure, according to court documents.
Evidence presented to the court during a nine-day hearing in June showed the heat index at the prison, the combination of temperature and humidity, topped 100 degrees during 13 days in 2016, and was between 90 and 99 degrees on 55 days. On July 19, the date of Ellison's ruling, it was 104. On Thursday, it was in the mid-90s with a heat index of more than 100.
Prison system officials argued they provide inmates with showers, fans and ice water, other ventilation, unlimited rest periods in air-conditioned areas and education concerning heat precautions. The prison infirmary at the Pack Unit is air conditioned along with administrative offices, visitation areas, the education department, the barbershop and a small portion of the prison craft shop, although housing areas are not.
Records show 23 Texas inmates have died of heat stroke since 1998, although no heat-related deaths have occurred at the Pack Unit, which was built in 1983. Texas has 106 prisons, 28 of them fully air conditioned.
Under the injunction, the prison agency also was told to install screens on windows in housing areas to keep out insects and develop a heat wave policy for the Pack Unit.
In a statement, the inmates' attorney, Jeff Edwards, called the state's proposal "a common-sense victory" that still falls short of a long-term solution to a long-ignored problem.
A hearing on the case is set for next week so attorneys for the inmates can respond.
The state has said it will appeal Ellison's ruling to the 5th U.S. Circuit Court of Appeals.
The prison agency had "substantial precautions ... in place to protect inmates from the summer heat," according to Texas Attorney General Ken Paxton. He also said Texas taxpayers "shouldn't be on the hook for tens of millions of dollars to pay for expensive prison air conditioning systems, which are unnecessary and not constitutionally mandated."
